How Child Support is Evaluated in Nepal

Under the family law guidelines of Nepal, child maintenance is not determined by arbitrary percentage tables. Instead, courts prioritize the welfare of the child and evaluate the actual living costs, dividing the responsibility between the parents in proportion to their financial capacity.

The Proportional Contribution Principle

Under the Children Act 2075, both parents have a joint responsibility to contribute to the child's upbringing. The court establishes child support through three primary steps:

  • Step 1: Calculate the Child's Budget: Summing up actual schooling fees, food, clothing, housing shares, and medical needs.
  • Step 2: Determine Relative Incomes: Assessing the net monthly income, business profits, and property-derived revenues of both the father and the mother.
  • Step 3: Split Proportionately: Dividing the total budget using the percentage share of each parent's income relative to the combined parental pool.

Important Factors Considered by Judges

During family court disputes, the judge has broad discretion to adjust the final support amount based on specific circumstances:

  • Special Healthcare Needs: If a child suffers from chronic illness or has physical/mental disabilities, the parent with greater means can be ordered to cover all medical costs.
  • Educational Level: Private schooling fees are evaluated based on what the parents could afford during their marriage, to maintain the child's academic stability.
  • Assets and Ancestral Property: If a parent lacks regular monthly income but owns extensive ancestral land (Amsabanda share), the court can order the liquidation of a portion or place a lien on it to secure the child's support.
