Legal Framework: The minimum marriage age in Nepal is established under Section 70 of the Muluki Civil Code 2074, which states that both parties must have completed 20 years of age for a valid marriage. Section 71 criminalises child marriage with penalties including imprisonment of up to 2 years and a fine of up to NPR 50,000. Marriages contracted below the minimum age are void ab initio under Section 72 of the Code.

The 20-Year Rule

According to the National Civil Code 2074, a marriage is only valid if both the male and the female have reached 20 years of age. There is no longer any provision for marriage at a younger age even with parental consent.

Consequences of Underage Marriage

• Void Marriage: Underage marriages are legally void (not recognized).
• Criminal Charges: Those organizing or participating in child marriages can face imprisonment and heavy fines.
• Registration Refusal: Ward offices and courts will not register any marriage where even one party is under 20.
