Divorce Grounds in Nepal
In Nepal, a divorce can be registered either with mutual consent or through contested litigation. If a spouse wants to file for divorce without the other\'s consent, they must prove one of the statutory grounds:
1. Adultery
If either spouse has proven sexual relations with another person. Circumstantial evidence like photos, hotel reservations, or witness testimony is evaluated by the judge.
2. Physical and Mental Cruelty
If a spouse inflicts severe bodily injury, commits domestic violence, or treats the other with mental cruelty that makes living together impossible.
3. Continuous Desertion
If a spouse abandons the other spouse and leaves the family household for a continuous period of 3 years or more without consent and without reasonable cause.
4. Separate Living
If the spouses have been living in separate households continuously for a period of 3 years or more with no physical relationship or reconciliation.
