Key Marriage Rules under Muluki Civil Code 2074
The Civil Code of Nepal establishes clear rules regarding court marriage. If you plan to register a marriage at the District Court, you must follow these laws:
1. Legal Marriageable Age (Dafa 70)
Unlike the older laws that allowed marriages at 18 with parental consent, the current law sets the minimum age at completed 20 years for both spouses. No exceptions or parental consent can bypass this age limit.
2. Single Status Verification
You must obtain an official Unmarried Status Certificate from your local ward office. If you were previously married, you must provide your official divorce certificate or your late spouse's death certificate.
3. Residency Recommendations
To register a marriage in a specific District Court, at least one partner must have resided in that district for at least 15 days. You must obtain a residency recommendation letter from the local ward office to prove this.
4. Witness Presence
You must bring at least two witnesses who are legal adults. They must bring their original citizenship certificates and sign the marriage register in front of the District Court judge.
